1. Purpose

These terms govern access to the Omachart website, published by THELI SAS. Omachart is provided as a free, online tool without warranty.

2. Free tool — no warranty

Omachart is provided free of charge. Diagrams are generated by an AI model and may contain errors, inaccuracies, or irrelevant output. No guarantee is given as to the accuracy, completeness, reliability, or suitability of the generated diagrams for any particular purpose.

The user is solely responsible for verifying, adapting, and validating all generated content before any use, particularly in professional, legal, or critical contexts.

3. Acceptable use

Users must use Omachart in compliance with applicable law, these terms, and our acceptable use policy. Prompts must not contain illegal, harmful, or abusive content.

4. Intellectual property

Diagrams generated by Omachart belong to the user who created them. However, Omachart does not warrant that generated content does not infringe third-party rights. The user is responsible for verifying the originality and lawfulness of their prompts and generated diagrams.

5. Limitation of liability

THELI SAS shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use Omachart, including but not limited to loss of data, business interruption, or decisions made based on generated diagrams.

6. Service availability

Omachart is provided on an "as is" and "as available" basis. THELI SAS does not guarantee uninterrupted access and may modify, suspend, or discontinue the service at any time without notice.

7. Third-party services

Omachart relies on third-party services (OpenRouter for AI, Vercel for hosting). THELI SAS is not responsible for the availability, performance, or policies of these third-party services.

8. Applicable law

These terms are governed by French law. The parties shall seek an amicable resolution before any legal action. Failing that, the competent courts shall be determined according to the legal rules applicable to the parties.
